These Terms and Conditions, including the O2D3 Privacy Policy (collectively “Terms”), govern Your use of services available on o2d3.com and its subdomains operated by O2D3 Physio & Fitness Solutions Pvt. Ltd. (“O2D3,” “We,” or “Us”), a company incorporated under the Companies Act, 1956, with its registered office located at No. 40, Vinayagar Koil St, Kullanampatti, Natham Rd, Nagalnagar, Dindigul, Tamil Nadu, 624003.

“You” or “Your” refers to any individual or corporate entity accessing the Website to purchase goods, use services, or schedule consultations or physiotherapy sessions through our online portal (“Transaction”).

Terms of Service

  • Your usual place of residence for purposes of place of supply shall be deemed to be the address on the card or bank account used by You to complete the Transaction.
  • The Transaction amount payable by You for goods or services includes all applicable charges for Services.

  • You agree to comply with all applicable laws, regulations, and government mandates relevant to the Services provided.

By accessing or using the Service, You agree to be legally bound by these Terms. If You do not agree with any part of these Terms, please do not access or use the Service.

  • You represent and warrant that You are over the age of 18. We do not permit individuals under 18 to use the Service in compliance with applicable laws. Parents or legal guardians may book consultations or services on behalf of minors; however, all contractual obligations remain with the parent or guardian.
  • Your use of the Service also requires acceptance and compliance with our Privacy Policy, which describes how we collect, use, and disclose Your personal information. Please review the Privacy Policy carefully before using the Service.

User Accounts

  • When You create an account with Us, You must provide accurate, complete, and current information at all times. This includes sharing your relevant health information and providing consent for treatment. Failure to provide accurate or updated health information may affect the quality and safety of the services provided.
  • If Your health situation changes or there are new health concerns, You must update Us immediately to ensure that the treating physiotherapist is fully informed. Failure to do so could result in risks during treatment for which O2D3 will not be liable.
  • You are responsible for safeguarding Your account password and any login one-time passwords (OTPs). You agree not to disclose Your password or login OTP to any third party.
  • However, as part of accessing certain services, You may be required to share a service start/stop OTP with the physiotherapist treating You. Each OTP message will clearly state that sharing the OTP with the physiotherapist is necessary to proceed to the next part of the process.
  • It is Your responsibility to share these specific OTPs only as instructed and to notify Us immediately if You become aware of any unauthorized use of Your account or any other security breach.
  • Your username must not:
    • Impersonate another person or entity.
    • Include names or trademarks you do not have authorization to use.
    • Use offensive, vulgar, or obscene language.
  • We reserve the right to suspend or terminate accounts that violate these rules.

Professional Standards and Registration

  • All physiotherapists and healthcare professionals engaged by O2D3 are duly qualified and registered as required under the Allied and Healthcare Professions Act, 2021, and any applicable State or Central regulations.
  • O2D3 undertakes to ensure that only registered professionals provide physiotherapy and related services, whether online or offline.

Teleconsultation & Tele-Physiotherapy

  • Most of our services are provided offline, and the Website functions primarily as a platform to facilitate service purchase, appointment scheduling, and to help ensure the quality and consistency of care.
  • In certain cases, at Your request, O2D3 may provide online consultations and physiotherapy sessions through its digital platforms. Such services will be delivered strictly in compliance with the Telemedicine Practice Guidelines, 2020, issued by the National Medical Commission, and any other applicable laws.
  • Only duly qualified and registered physiotherapists and healthcare professionals will provide advice or treatment online.
  • Explicit informed digital consent will be obtained from You prior to commencing any teleconsultation.
  • Records of such consultations will be maintained securely in compliance with healthcare record-keeping laws.
  • You acknowledge that online physiotherapy has limitations compared to in-person evaluation. In cases where physical examination is essential, You will be advised to seek in-person care.

Rules and Regulations

  • Visitors must comply with all rules, policies, and guidelines, including safety instructions and proper use of equipment.
  • We reserve the right to refuse access or terminate memberships for any breach of these Terms.

Payment & Fees

Consultation Fees

  • Consultation fee is required to book an appointment and secure a slot.
  • Consultation appointments can be rescheduled subject to availability.

Physiotherapy Packages

  • An advance payment is required for all physiotherapy session packages.
  • Payment must be completed before commencement of any physiotherapy services.
  • Physiotherapy sessions must be used within the specified validity period. Unused sessions after this period will be forfeited.
  • Rescheduling of physiotherapy sessions is permitted subject to availability.

Accessories

  • An advance payment is required for purchases of accessories from O2D3.
  • For accessories purchased via affiliate marketing links, the terms and conditions of the respective third party apply.

Payment Methods

  • We do not accept direct cash payments.
  • We accept payments via UPI or through various methods supported by Razorpay, including but not limited to:
    • Debit and Credit Cards (Visa, MasterCard, American Express, Diners Club, Discover)
    • UPI apps such as Google Pay, PhonePe, BHIM UPI
    • Netbanking from multiple banks
    • Popular digital wallets like JioMoney, Mobikwik, Airtel Money, and others
    • EMI options including cardless EMI and other provider EMIs
    • Bank transfers and meal cards (where applicable)
  • All card payments (credit and debit) and other payment modes are subject to validation and authorization by your card issuer or service provider. If authorization fails, we will notify You and provide alternative payment methods.

Taxes

  • All charges displayed for services and products are inclusive of applicable Goods and Services Tax (GST) unless stated otherwise. O2D3 will issue valid GST-compliant invoices upon request. Exemptions, if any, for specific healthcare services will be applied in accordance with prevailing tax laws.

Refunds and Cancellations

  • Failure to complete payment may result in cancellation of bookings or orders.
  • Consultation and physiotherapy package fees are generally non-refundable once availed.
  • However, in compliance with the Consumer Protection Act, 2019, refunds will be provided in cases of:
    • Service deficiency attributable to O2D3.
    • Double payment or billing errors.
    • Cancellations initiated by O2D3.
  • You may reschedule sessions subject to availability and advance notice. Please notify Us as soon as possible if you need to reschedule.
  • Refund claims will be processed within 7–14 business days from the date of approval.

Personal Information and Privacy

  • Your personal information collected by O2D3 is managed in accordance with Our Privacy Policy, which describes how we collect, use, disclose, and protect Your personal data. We are committed to handling Your data securely and respecting Your privacy rights under applicable laws.
  • We may use Your personal information for marketing purposes only with Your consent and as permitted by law. You have the right to opt-out of marketing communications at any time by following the instructions provided in those communications or by contacting us directly.

All personal and health data collected during consultations, physiotherapy sessions, and other services are handled with strict confidentiality and in compliance with applicable healthcare data protection laws in India.
  • Access to your health information is limited strictly to authorized healthcare professionals and staff directly involved in your care. We do not disclose your health data to any third parties without your explicit consent, except as required by law or to facilitate your treatment with trusted partners.
  • By using our Services, you expressly consent to the collection, storage, and use of your health information necessary for providing care and as outlined in our Privacy Policy.

Promotions

  • Any Promotions offered through the Service, such as contests or sweepstakes, are governed by separate rules and eligibility criteria specific to each Promotion.
  • By participating in a Promotion, You agree to comply with the applicable Promotion rules as well as Our Privacy Policy.
  • In the event of any conflict between these Terms and the Promotion-specific rules, the Promotion rules shall take precedence.
  • Personal information collected during Participation in Promotions will be handled in accordance with Our Privacy Policy.

Termination

  • We may suspend or terminate Your Account immediately, without prior notice or liability, for any reason including, but not limited to, Your breach of these Terms, violation of applicable laws, or misuse of the Service.
  • Upon termination, Your right to access and use the Service will cease immediately. Termination shall not affect any rights or obligations accrued prior to termination, including payment obligations.
  • If You wish to terminate Your Account, You may do so by discontinuing use of the Service or by contacting Us to request account closure.
  • Post-termination, Your personal data will be handled in accordance with Our Privacy Policy and applicable laws.
  • O2D3 shall not be liable for any loss or damages arising from the termination or suspension of Your Account.

Limitation of Liability

  • To the maximum extent permitted by law, O2D3, including its officers, directors, employees, and affiliates, shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages, including but not limited to injury, loss, death, accident, delay, or lost profits arising out of or related to Your use or inability to use the Service.
  • Our total aggregate liability relating to any Transaction or services provided shall not exceed the amount You have paid to O2D3 in connection with that Transaction.
  • Liability shall be proportionally reduced to the extent any loss or damage is caused or contributed to by You or third parties.
  • This limitation applies regardless of the legal theory and even if We have been advised of the possibility of such damages.

Disclaimer of Warranty

  • To the fullest extent permitted by applicable law, the Services provided by O2D3 are made available on an “as is” and “as available” basis without any warranties, express or implied.
  • O2D3 disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
  • We do not warrant that the Services will be uninterrupted, error-free, or meet Your specific requirements.

Governing Law and Dispute Resolution

  • These Terms shall be governed by and construed in accordance with the laws of India.
  • Any dispute, controversy, or claim arising out of or relating to these Terms, including the breach, termination, or validity thereof, shall be subject to the exclusive jurisdiction of the courts located in Chennai, Tamil Nadu, India.
  • Before initiating any legal proceedings, the parties agree to attempt to resolve disputes through good faith negotiation. If unresolved within 30 days, the dispute may be submitted to arbitration or litigation as agreed by the parties.

General

  • The Services are provided by O2D3 to You on an independent principal-to-principal basis. Nothing in these Terms creates or shall be deemed to create any partnership, joint venture, agency, or employment relationship between You and O2D3.
  • No failure or delay by O2D3 in enforcing any provision of these Terms or exercising any right shall operate as a waiver of that provision or right. The exercise of one or more rights shall not preclude the exercise of others.
  • Any waiver of any provision shall be effective only if made in writing and signed by a duly authorized officer of O2D3.
  • These Terms constitute the entire agreement between You and O2D3 regarding Your use of the Service and supersede all prior agreements.
