Ltd (“O2D3”), a company incorporated under the provisions of the Companies Act, 1956 and having its registered office O2D3 Physio & Fitness Solutions Pvt. Ltd., No. 40, VINAYAGAR KOIL ST, KULLANAMPATTI, NATHAM RD, Nagalnagar, Dindigul, TN, 624003. “We” or “Us” shall refer to O2D3. “You” or “Your” refers to any non-registered individual or corporate body, making or attempting to the services available at www.o2d3.com to purchase goods or services on the website, or schedule an appointment for a consultation or physiotherapy session through an online portal owned and operated O2D3 (“Transaction”).

You understand and agree that O2D3 will treat Your use of the website www.o2d3.com as acceptance of these Terms from such point of usage. You agree that O2D3 reserves the right to update the Services and these Terms from time to time without prior notice to You. Your continued access or use of the Services signifies Your assent/ratification of the updated or modified Terms.

Terms of Service

In order to enable Services, it shall be deemed that Your usual place of residence shall be as per the details available in the card used by You to complete the Transaction for the purposes of place of supply.
The Transaction amount payable by You towards the purchase of goods or services from a merchant shall be inclusive of charges for Services availed by You.
You may reach out to accounts@o2d3.com, by providing the payment ID and Your contact number, to get invoices for your Transactions.
You shall comply with all applicable laws, including laws, statute, rule, regulation, order, circular, decree, directive, judgment, decision or other similar mandate of any applicable central, national, state or local governmental/regulatory authority having competent jurisdiction and force of law over, or applicable to You, Us or the subject matter in question, as may be amended from time to time.

Payments

Payment can be made through various payment methods we have available, such as Rupay Card, Visa, MasterCard, Affinity Card, UPI Payment, UPI based Wallet service providers.

Payment cards (credit cards or debit cards) are subject to validation checks and authorization by your card issuer. If we do not receive the required authorization, we will notify you and provide alternative payment options.

Rules and Regulations

Visitors must comply with all our rules, policies, and guidelines, including safety instructions and proper equipment use.
We reserves the right to refuse access or terminate memberships for any breach of these terms.

Payment and Fees

Consultation Fees

A non-refundable consultation fee is required to book an appointment.
Payment must be made in advance to secure the consultation slot.
Clients can reschedule consultation slots subject to availability.
Failure to attend the consultation session without prior notice may result in forfeiture of the fee.

Physiotherapy Packages

Advance payment is required to purchase sessions for all physiotherapy plans.
Payment must be completed before the commencement of any services.

Advance payment is required to purchase accessories.

In case you are diverted to a third-party website to complete the purchase of your product, the terms and conditions of the third party shall apply.

Accepted Methods

Payments can be made via UPI, net banking, or debit/credit cards.

Refunds and Cancellations

Consultation fees and Physiotherapy Packages are non-refundable under any circumstances.
Clients may reschedule consultation slots, subject to availability, but refunds will not be provided.
Physiotherapy sessions are to be used within the specified validity period. Physiotherapy sessions not used within the specified validity period shall be forfeited.

Personal Information and Privacy

Personal information collected will be managed according to our Privacy Policy.
We may use personal information for marketing purposes, subject to applicable law.

Promotions

Any Promotions made available through the Service may be governed by rules that are separate from these Terms.

If You participate in any Promotions, please review the applicable rules as well as our Privacy policy. If the rules for a Promotion conflict with these Terms, the Promotion rules will apply.

Termination

We may terminate or suspend Your Account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if You breach these Terms and Conditions.

Upon termination, Your right to use the Service will cease immediately. If You wish to terminate Your Account, You may simply discontinue using the Service.

Limitation of Liability

O2D3 (including its officers, directors, employees, representatives, affiliates, and providers) will not be responsible or liable for any injury, death, loss, claim, act of God, accident, delay, or any direct, special, exemplary, punitive, indirect, incidental or consequential damages of any kind (including without limitation lost profits or lost savings), whether based in contract, tort, strict liability or otherwise, that arise out of or is in any way connected with (i) any failure or delay (including without limitation the use of or inability to use any component of the Pay in Native Services), or (ii) any use of the Pay in Native Services or content, or (iii) the performance or non-performance by Us, even if We have been advised of the possibility of damages to such parties or any other party. Notwithstanding anything under these Terms, O2D3’s aggregate liability and that of its affiliates, officers, employees and agents relating to the Pay in Native Services, will not exceed an amount equal to the total amount paid by You in relation to the Transaction giving rise to the liability. O2D3’s liability under or in connection with Terms will be proportionately reduced to the extent any loss or damage is contributed to by You or Your third party providers.

Disclaimer of Warranty

You acknowledge and agree that to the maximum extent permissible, the Pay in Native Services are provided on an “as is” basis. You acknowledge that O2D3 does not warrant that the Pay in Native Service(s) will be uninterrupted or error free or fit for Your specific business purposes.

Governing Law and Dispute Resolution

General

You acknowledge and agree that the Services are provided on an independent principal-to-principal basis by O2D3 to You.
Any failure or delay by O2D3 to enforce or exercise any provision of these Terms, or any related right, shall not constitute a waiver by O2D3 of that provision or right. The exercise of one or more of O2D3’s rights hereunder shall not be a waiver of, or preclude the exercise of, any rights or remedies available to O2D3 under these Terms or in law or at equity. Any waiver of any provision shall only be effective if made in writing and executed by a duly authorized officer of O2D3.
